The NJ Real Estate Commission regulates timeshare law in NJ through the New Jersey Real Estate Timeshare Act. The act applies to all timeshares located within the state of New Jersey as well as those located outside NJ but sold within the state.

Developer Duties

New Jersey timeshare law states that the developer is responsible for all timeshare contracts as well as all advertisements, offerings, and sales agents related to the selling of the timeshare plans. Under C.45:15-16.58 if any other these areas are in violation of the code, the developer is also in violation.

New Jersey Timeshare Cancellation

A purchaser has up to seven calendar days to cancel a timeshare contract in New Jersey. According to timeshare law C.45:15-16.67, this seven day cancelation period begins immediately after either the signing of the timeshare contract or receipt of the public offering statement, whichever is later. Under this timeshare law, in New Jersey the purchaser may send notice of cancellation by certified mail or deliver in person. The seller must refund all payments within 30 days.
